The Services

The Customer and Therapist must be 18 years of age or older to use this Website and the Website Services. RSCPP is only able to provide the Website Services to UK residents who are UK cardholders and therefore by the Customer and Therapist using the Website the Customer and Therapist are warranting to RSCPP that they are each a UK resident and a UK cardholder and shall take full responsibility for any costs or losses incurred by RSCPP as a result of the Customer or the Therapist breaching this warranty. RSCPP will be entitled to withdraw the Website Services from any Customer or Therapist whom RSCPP discovers is ineligible to use the Website Services immediately. Refunds of payments made by the Customer or Therapist will be fair but at the sole discretion of RSCPP.

The Therapist agrees to update the Website so all their professional information, fees and availalability is accurate and so that the Customer can pay for: the first face to face Clinical Service appointment in advance online at the Website or by telephoning RSCPP during office hours or at the appointment by cash or cheque made payable to the Therapist and to collect payments directly from the Customer for all subsequent appointments; all telephone Clinical Service appointments for the whole duration of the telephone Clinical Service in advance online at the Website or by telephoning RSCPP during office hours; all email Clinical Services exchanges for the whole duration of the email Clinical Service in advance online at the Website.

For email Clinical Services only the Customer must register at the Website where the Customer and Therapist correspondence is stored securely: the Customer will only be required to fill out an online assessment form once; if the Customer decides to have an email Clinical Service with an additional Therapist via the Website the Customer must re-register to do so; the Customer must understand that they will not be able to use one registered email address to access the Website in connection with more than one Therapist; the Customer is therefore advised to register with a different email address if they choose to work with an additional therapist, so that the Customer can access information they have saved on the Website in connection with both Therapists; the Customer will not be able to use any email address to log-in and view their information so far saved at the Website other than their currently registered email address(es); if the Customer forgets or looses any registered email address(es) they must re-register if they want to receive any Website Services or new email Clinical Services.

The Customer agrees: that all of the Therapist's arranged Clinical Services are chargeable; to pay for the Therapist's Clinical Service(s) by the methods stated. The Customer agrees that the Therapist's Clinical availability and unavailability is decided by the Therapist and not by RSCPP. Any Clinical Services the Therapist provides to the Customer via the Website Services will correspond to the Fees the Therapist enters at the Website during the registration process or updated Fees the Therapist provides RSCPP with thereafter, whether the Fees be for Individuals, Children, Couples, Families and/or Groups. RSCPP cannot be held responsible for the Therapist failing to inform RSCPP of any changes to the Fees the Therapist charges the Customer for their Clinical Service(s) via the Website Services. The Therapist's consulting address (unless the Therapist has not provided the Therapist's consulting address in full on the Therapist's profile webpage for security reasons in which case it is the responsibility of the Therapist to provide the full consulting address to the Customer) and appointment(s) date and time for any booked face to face Clinical Services, and the Therapist's telephone number and appointment(s) date and time for any booked telephone Clinical Services (unless the Customer has paid by phone in which case it is the responsibility of the Therapist to provide the Therapist telephone number to the Customer), will be provided for the Customer on their payment 'confirmation' webpage and their 'view appointments' webpage. The Customer understands that the Customer will automatically be emailed notifications at the Customer's registered email address by RSCPP from an email address ending with @rscpp.co.uk and the Customer must therefore: ensure these notifications arrive in the Customer's registered email address inbox and not the Customer's junk or spam folder and check the Customer's registered email address account regularly in order to be aware of these notifications. Such notifications will be emailed to the Customer when the Customer: registers at the Website (in order to provide the Customer with an authentication code); requests a new authentication code (in order to provide the Customer with a new authentication code); requests a new password (in order to provide the Customer with a new password); has a clinical or administrative message waiting in the Customer's online encrypted mailbox at the Website from the Customer's Therapist (in order to inform the Customer that the message is waiting, in which case the Customer must log-in at the Website to view the actual message); and when the Customer cancels their Website Services registration (in order to confirm the Website Services registration cancellation to the Customer). The Customer agrees that the Therapist may require assessment and further assessment information from the Customer in order to decide if the Clinical Service(s) the Customer may desire is appropriate or not for the Customer and the problems the Customer was or is experiencing. The Customer agrees that assessment and further assessment Clinical Service is chargeable. The length of time the Therapists spends on each Clinical Service(s) face to face or telephone appointment or email exchange response per 24,000 character assessment form, per further assessment or per 400 word block the Customer pays for (if the Customer writes up to eight hundred words it will cost them twice as much, and so on in multiples of four hundred words and the Website will inform the Customer whenever they have written a block of four hundred words, and let them know whether they need to make a further payment to continue, alternatively, the Customer may wish to edit their email back down below the last four hundred block, and if the Customer pays to write up to eight hundred words, and uses less than four hundred words, they will be able to write another email up to four hundred words later), and the overall duration of each Clinical Service(s) the Therapist provides is a clinical matter for the Therapist only and an indication for guidance purposes only is provided by the Therapist on the Therapist's profile webpage. During the provision of the Therapist's Clinical Services and only when the Therapist is providing a telephone and/or an encrypted email Clinical Service the Customer is advised to keep the Therapist informed of any change in their contact details and/or their GP's contact details, by submitting such details to the Therapist via the Customer's 'change details' webpage in the logged-in area of the Website. When the Therapist is providing a face to face Clinical Service to the Customer the Customer should inform the Therapist directly of any change to their contact details or their GP's contact details. If the Customer wishes to change between face to face, telephone or email Clinical Services, the Customer is advised to discuss this matter with the Therapist first as the Therapist may want to establish whether a different type of Clinical Service is appropriate or not for the Customer and the problems the Customer was or is experiencing. If the Customer wishes to change their current Therapist for another Therapist, the Customer may wish to discuss this matter with their current Therapist first. Privacy information on Customer's use of the Website Services is detailed in the Privacy Policy which forms part of these Terms and Conditions. NB. By registering for the Website Services and by making any booking for any Clinical Services via the Website, the Customer is confirming unequivocally the following: that they agree to the terms of this agreement; that both RSCPP and the Therapist may use any personal information disclosed by the Customer in accordance with the Privacy Policy which forms part of these Terms and Conditions; that the Customer will not provide any information to either RSCPP, the Website, or the Therapist, which they are not entitled to provide or which infringes any law or regulation; that the Customer understands and accepts that whilst both RSCPP and the Therapist will do their best to ensure that their preferred Therapist provides the Clinical Services to the Customer, should they be unavailable, either RSCPP or the Therapist may arrange for an alternative Therapist to provide the Clinical Services to them.

To be registered on this Website and have a Therapist's profile webpage on this Website and provide Clinical Services via or in connection with this Website, the Therapist must always hold the professional body status of being BABCP Accredited, BACP Accredited, BASRT Accredited, BPC Registered, BPS Chartered, CP-UK Registered, HPC Registered or UKCP Registered, and must provide RSCPP with evidence of such a professional body status via a verifiable entry on the relevant professional body website or via a relevant professional body membership number, both during application to be registered on this Website and following any renewal of such a professional body status, and inform RSCPP immediately if such a professional body status ceases, as this information is available to the Customer on the Therapist's profile webpage and therefore the Therapist must keep RSCPP up to date regarding this information in order to protect the interests of both RSCPP and the Customer. The Therapist must have professional indemnity insurance for any Clinical Service(s) they provide via or in connection with the Website and/or the Website Services, and the Therapist must provide evidence of their professional indemnity insurance to RSCPP both upon registration at the Website and upon renewal of their insurance. The Therapist is registered on the Website on the contactual basis of being a self-employed independent contractor. The Therapist agrees to be clinically responsible for any Clinical Service(s) the Therapist provides to the Customer via or in connection with the Website Services: assessment and/or counselling and/or psychotherapy and/or psychoanalysis and/or psychology; provided either face to face and/or by telephone and/or via encrypted email correspondence. If the Therapist provides Telephone Clinical Services the Therapist agrees to provide a UK landline telephone number for the Customer charged at standard rate call charges or an 0845 telephone number charged at local rates and not a telephone number at premium-rate call charges; the Therapist will be liable for re-imbursing the Customer directly for any costs that the Customer entails in this regard if the Therapist does not comply. The Therapist agrees to gather information from the Customer during pre-initial Clinical Service(s) communications between the Therapist and the Customer in order to ascertain if the Therapist's safety is likely to be compromised in any way whatsover through providing any Clinical Service(s) to the Customer, and the Therapist agrees to both act on this information in order to protect the Therapist's safety and take sole responsibility for deciding to provide the Customer with the Clinical Service(s). The Therapist is responsible for deciding which Clinical Service(s) they are qualified to provide either face to face and/or by telephone and/or via encrypted email, and their clinical availability in terms of times and dates, and the updating of their clinical availability at the Website. The Therapist must assess if the Clinical Service(s) they provide either face to face and/or by telephone and/or or encrypted email are appropriate or not for the Customer and the problems the Customer was or is experiencing. The Therapist agrees to be responsible for arranging and attending their own clinical supervision as required by their professional body. The Therapist must attend their regular clinical supervision whilst they are registered at the Website. The Therapist has a duty to keep reference to the Customers' material as anonymous as possible. The Therapist agrees to keep the content of their clinical work confidential and will only discuss it in clinical supervision unless required to in other circumstances as detailed within 'Limitations to Confidentiality' under the Privacy Policy which forms part of these Terms and Conditions. The timing for ending any Clinical Service(s) with the Customer is a clinical matter to be mutually agreed by the Therapist and the Customer. The Therapist must understand that they will automatically be emailed notifications at the Therapist's registered email address by RSCPP from an email address ending with @rscpp.co.uk and the Therapist must therefore ensure these notifications arrive in the Therapist's registered email address inbox and not the Therapist's junk or spam folder, and that these notifications will be emailed to the Therapist when the Therapist: registers at the Website (in order to provide the Therapist with an authentication code); requests a new authentication code (in order to provide the Therapist with a new authentication code); submits registration details (in order to provide the Therapist with a confirmation email); has a web profile published on the Website; and each time the Customer; requests via the 'contact me' link on the Therapist's web profile that the Therapist contacts the Customer; pays for a Clinical Service(s); submits an online assessment form for an encrypted email assessment, encrypted email further assessment information, encrypted email counselling information; changes the Customer's contact details at the Website; changes the Customer's GP's contact details at the Website; cancels the Customer's registration at the Website for encrypted email Clinical Services and not after booking an online assessment but only from when the Customer has actually submitted the online assessment form to the Therapist onwards, and the Therapist must therefore check their registered email address account regularly in order to be aware of these notifications and understand that such notifications contain limited information about the Customer in order to protect the Customer's privacy and therefore upon receiving such a notification the Therapist must log-in at the Website and view via the 'view referrals and clients' webpage the actual Customer information to which the Therapist has been notified and respond to or act on the Customer's information as soon as the Therapist is able to or within 48 hours excluding weekends and public holidays if the Clinical Service being provided by the Therapist is via encypted email, and for any telephone Clinical Service appointments the Therapist must log-in to the Website and add in advance all appointments to the Website so the Customer has sufficient time to pay in advance for each appointment, and for an encrypted email Clinical Service the Therapist must use the Website functionality correctly by logging-in at the Website immediately following the Therapist's web profile being published and view the 'email therapy faq' webpage for guidance, and the Therapist must copy all Customer information to a secure environment other than the Website, so that these details are accessible by the Therapist in the event of the Website experiencing a technical problem resulting in the Therapist being unable to view these details at the Website, and the minimum GP contact details required by the Customer are the GP's name and the GP's telephone number, and the Therapist must clarify the accuracy of this information with the Customer if the Therapist deems this necessary, and/or request more GP details from the Customer, by requesting the Customer to update and submit to the Therapist their 'change details' webpage, in order for details to populate the Therapist's 'client' webpage. It is the responsibility of the Therapist to keep their copy of this information up to date in a secure environment other than the Website including when the Customer first submits their details and/or updates their details. RSCPP will send an SMS to the Therapist's registered mobile telephone number in order that the Therapist is made aware of the Customer's 'contact me' request(s) and payment(s) for the Therapist's Clinical Service(s) as soon as possible only if the Therapist has selected to receive SMS messages by logging in at the Website and making the appropriate selection. If the Therapist forgets their password the Therapist must obtain a new password via the 'lost password' webpage. The Therapist will not be able to use any email address to log-in and view their information so far saved at the Website other than their currently registered email address. If the Therapist forgets or looses any registered email address they must re-register if they want to receive any Website Services or provide new Clinical Services: they will be unable to access the information they accessed with their old email address via their new email address. The Therapist must keep the Website up to date as to their clinical availability and unavailability via the 'manage availability / alerts' webpage in order for any potential Customer and RSCPP to ascertain if the Therapist's Clinical Service(s) are available or not, and the Therapist must inform both the Customer and RSCPP if they are unavailable for any Clinical Service(s) any existing Customer has booked with them. The Therapist is entitled to breaks/holidays and must inform RSCPP via the 'manage availability / alerts' webpage and the Customer well in advance of any breaks/holidays. RSCPP cannot be held responsible by anyone for the Therapist failing to fulfill their clinical and administrative responsibilities. Privacy information on Therapist's Use of the Website Services is detailed in the Privacy Policy which forms part of these Terms and Conditions. NB. By registering for the Website Services and by providing any Clinical Services via or in connection with the Website, the Therapist is confirming unequivocally the following: that they agree to the terms of this agreement; that both RSCPP and the Customer may use any personal information disclosed by the Therapist in accordance with the Privacy Policy which forms part of these Terms and Conditions; and that the Therapist will not provide any information to either RSCPP, the Website, or the Customer, which they are not entitled to provide or which infringes any law or regulation.

The Therapist agrees either to a free web profile webpage, or the Therapist agrees to pay RSCPP for a premium listing for their web profile webpage at a fee of £10 per month and agrees to pay this fee by direct debit or similar arrangement from the time the Therapist requests a premium listing from RSCPP for their web profile webpage on the Website. The Therapist agrees to pay RSCPP this fee pro rata on a monthly basis - e.g. if the Therapist requests a premium listing half way through a month RSCPP will not charge the Therapist for the whole of that month, RSCPP will charge the Therapist for the remaining half of that month and the following month and the Therapist agrees to to pay for their premium listing on this basis. Alternatively the Therapist may pay RSCPP in advance for a premium listing for a year at a fee of £100 in which case the Therapist agrees to pay for their premium listing on this basis. RSCPP will contact the Therapist in order to request their bank account details including the account holder name, sort code, and account number in order for RSCPP to arrange the direct debit or similar arrangement. Premium listing fees are non-refundable. The Therapist agrees to be responsible for selecting which Clinical Service(s) they provide via the Website Sevices and by doing so agree that: RSCPP will charge the Therapist fifty percent of both the first and second face to face Clinical Service appointments the Customer attends and if the Customer pays for and attends one appointment and does not attend a second appointment or if the Customer pays in advance for the first appointment and does not attend the appointment or give adequate cancellation notice RSCPP and the Therapist will share the amount paid by the Customer equally; RSCPP will charge the Therapist twenty pecent of all telephone and/or email Clinical Services for the whole duration of the Clinical Services(s) and RSCPP will pay the Therapist via bank transfer subject to the Therapist providing the correct account number and sort code the Therapist's clinical fee of eighty percent of each payment made by the Customer within thirty five days of RSCPP receiving each payment from the Customer and RSCPP will email the Therapist any appropriate payment advice. If RSCPP discovers that the Therapist has taken money from the Customer contrary to these Terms and Conditions RSCPP will consider this a serious breach of trust; in this case RSCPP will email the Therapist two weeks notice of Website Services registration cancellation at the Therapist’s registered email address; it will be the sole responsibility of the Therapist to make alternative arrangements for continuing the provision of their Clinical Service(s) to the Customer and any other Customer(s) they are providing any Clinical Service(s) to via or in connection with the Website; where a Customer has not booked one of the Therapist’s Clinical Services for a period of two weeks or more RSCPP will email the Therapist at their registered email address asking the Therapist to confirm by return email that the Customer no longer wishes to receive the Therapist’s Clinical Service(s); the Therapist must supply this information or provide a satisfactory reason without including clinical information by replying to RSCPP via their email within one week of the email being sent; if the Therapist is unable to provide a satisfactory answer RSCPP reserves the right to either suspend or cancel the Therapist’s Website Services registration; RSCPP reserves the right to take action to both establish and recover from the Therapist any usage fees the Therapist has denied RSCPP. In the event of a chargeback, whereby the Customer's card has been used in an unknown or fraudulent online transaction at the Website, the Therapist will be liable for all costs incurred by RSCPP up to the value of the transaction. RSCPP uses the Protx payment system which uses a combination of established and innovative techniques to ensure the security and integrity of all sensitive data in order to avoid chargebacks.
